क्षतिपूर्ति शुल्क के स्थानांतरण पर एनजीटी ने डीपीसीसी पर लगाया 50 हजार रुपये का जुर्माना
वन एवं वन्यजीव विभाग को क्षतिपूर्ति शुल्क स्थानांतरित करने में बहुत ज्यादा देरी के लिए नेशनल ग्रीन ट्रिब्यूनल (एनजीटी) ने दिल्ली प्रदूषण नियंत्रण समिति (डीपीसीसी) पर 50,000 रुपये का जुर्माना लगाया है। एनजीटी चेयरमैन न्यायमूर्ति प्रकाश श्रीवास्तव की अध्यक्षता वाली पीठ ने कहा कि डीपीसीसी के बेबुनियाद बहाने बनाकर एनजीटी के आदेशों का पालन नहीं किया और क्षतिपूर्ति राशि स्थानांतरित करने में देरी का कारण स्वीकार्य नहीं हैं।
एनजीटी ने रिकार्ड पर लिया कि क्षतिपूर्ति शुल्क के स्थानांतरण में देरी उसके कार्यालय की शिफ्टिंग के कारण हुई थी। एनजीटी ने कहा कि शुल्क के स्थानांतरण में एक साल से अधिक की देरी को लेकर बताया गया कारण पूरी तरह से गलत है। एनजीटी ने कहा कि ट्रिब्यूनल के आदेश का पालन करना एक अपराध है और डीपीसीसी के चेयरमैन और सदस्य सचिव पर भी ऐसे उल्लंघन के लिए मुकदमा चलाया जा सकता है।
एनजीटी ने कहा कि हालांकि, ट्रिब्यूनल मुकदमा चलाने का निर्देश देना उचित नहीं समझता। हालांकि, इसके लिए डीपीसीसी पर जुर्माना लगाना उचित होगा। नवंबर 2023 में एनजीटी ने डीपीसीसी को निलोठी गांव में चार गैर-कानूनी पत्थर तोड़ने वाली यूनिट से पर्यावरण क्षतिपूर्ति के तौर पर इकट्ठा किए गए आठ लाख रुपये वन एवं वन्यजीव विभाग को जारी करने का निर्देश दिया था। साथ ही विभाग को निर्देश दिया गया था कि उक्त धनराशि का उपयोग गांव में पेड़ लगाने के कामों के लिए किया जाएगा।
इसके साथ ही एनजीटी ने डीपीसीसी पर 50,000 रुपये का जुर्माना लगाया और कहा कि यह राशि एनजीटी आने वाले जनता के लिए सुविधाओं में उपयोग की जाएगी। साथ ही वन एवं वन्यजीव विभाग को निर्देश दिया कि आठ लाख रुपये का उपयोग वृक्षारोपण के लिए करें और छह महीने के भीतर रिपोर्ट प्रस्तुत करें।
